Connecticut town government pays fines for safety violations

Connecticut's Occupational Safety and Health Administration, or CONN-OSHA, is known for responding to complaints or work accidents and imposing fines on private employers who provide their employees with an unsafe working environment. However, CONN-OSHA also conducts random inspections and can impose fines on even government agencies when they violate safety standards.

Connecticut law and the "substantial certainty" exception

Under Connecticut law, workers' compensation is supposed to provide an exclusive remedy. This means that an employee who collects workers' compensation benefits after being injured in a workplace accident is typically barred from filing suit against the employer over the same incident.

The workers' compensation system in Connecticut covers many types of injuries sustained while at work. However, typically the key element that the injured must prove is that the injury was work-related. This is relatively easy to do when the injury comes from a workplace accident, such as a machinery accident or a slip and fall. It can be trickier when the injury is cumulative, such as carpal tunnel syndrome or repetitive strain injury.

A construction company has been cited for "willful and serious" safety violations in an investigation into a crane accident at a Connecticut construction site earlier this year. The Occupational Safety and Health Administration imposed fines on the company totaling $162,500.
